Privacy Agreement

1. General provisions:

1.1. This Privacy Agreement establishes the procedures for collecting, storing, processing, using and disclosing the personal data of Customers that LLC "ОН-ЛАЙН" and/or LLC "Он Лайн" (hereinafter the Registrar), which own the bestname.ua website, receive from Customers under service agreements, including the public offer. This Agreement forms an integral part of the Agreements under which services are provided.

1.2. To obtain one or more services, including, but not limited to, services supporting a domain name, the Customer must express full consent to the terms of this Privacy Agreement. Receiving services from the Registrar constitutes full acceptance of these terms.

1.3. The Customer may not use the Registrar’s services if the Customer disagrees with this Agreement, has not reached the age at which the law permits agreements with the Registrar, or is not an authorised representative of the company.

1.4. By receiving services from the Registrar, the Customer gives unequivocal consent to this Privacy Agreement and grants the Registrar the right to collect, store, process, use and disclose the personal data of the Customer and/or authorised persons under its terms.

1.5. The Registrar is not responsible for the collection, storage, processing, use or disclosure of the Customer’s personal data by third parties that the Registrar does not own or control, or by individuals who are not the Registrar’s employees, even if the Customer accessed those parties’ websites, goods or services through the Registrar’s website or mailing.

1.6. The Customer acknowledges that failure to take due care of the security and protection of personal data and authentication details may allow third parties to gain unauthorised access to the Customer’s account and personal or other data. The Registrar is not liable for losses caused by such access.

2. Personal data that may be collected.

The Registrar collects personal information, including first name, surname, patronymic, company name, company details, contact telephone numbers, email address and company location. The Registrar may also collect other information:

- the Customer’s IP address;

- information about errors in the operation of the resource.

All information is collected by the Registrar as provided and is not altered during collection.

3. Customer information the Registrar may use.

The Registrar may use the Customer’s first name, surname, patronymic and email address. The Registrar may display the Customer’s first name, surname, patronymic, company name, company details, contact telephone numbers, email address and company location on bestname.com.ua. The Registrar may use your contact details for mailings informing the Customer about new features, promotions and other bestname.com.ua news. The Customer may opt out of mailings to these contact details at any time by sending a message to the Registrar’s representatives.

4. Conditions for access to the database.

The Registrar does not disclose personal data to third parties except as specified below. Under this Privacy Agreement, the Customer authorises the Registrar to disclose Customers’ personal data to third parties providing services to the Registrar, including, but not limited to, payment processing and parcel delivery. Such third parties may use Customer information only when providing services to the Registrar and only to the extent necessary to provide those services.

Personal data may also be disclosed without the consent of the Customer or an authorised representative in cases specified by law and only in the interests of national security, economic well-being and human rights, including, but not limited to:

- substantiated requests from government authorities entitled to request and obtain such data;

- cases in which, in the Registrar’s opinion, the Customer breaches this Privacy Agreement and/or other contracts or agreements between the Registrar and the Customer.

5. Changing or deleting the Customer’s personal information.

The Customer’s personal data is retained for three years after termination of the Agreement.

If you have questions, requests or complaints about the information you provide, please contact billing@bestname.com.ua.

Upon a written request and presentation of a document establishing identity and authority, the Customer may be provided with information on how to obtain details about the location of the database.

7. Protection of collected information.

The Registrar takes all reasonable precautions to protect the confidentiality of data. All data collected by the Registrar is stored on one or more secure database servers and cannot be accessed from outside the Registrar’s corporate network. Only employees whose duties require access to Customers’ personal information may access that information. All employees with access to Customer information have signed an agreement prohibiting disclosure of Customer information to third parties.

8. Changes to the Privacy Agreement.

We may change the terms of the Privacy Agreement. In that event, we will replace the version on the terms page of the Registrar’s official website. Please review these terms periodically to stay informed about how the Registrar protects Customer information.

All amendments to the Agreements take effect upon publication. By receiving services from the Registrar, the Customer gives unequivocal consent to the amended Privacy Agreement in the version in effect when those services are used.

The Registrar is not liable for losses or damage suffered by the Customer or third parties as a result of an incorrect understanding or misunderstanding of this Privacy Agreement, instructions or guidance on using the Website, placing data, or other technical matters.

9. Additional terms.

If any provision of this Privacy Agreement, including a sentence, clause or part of a clause, is found to conflict with the law or to be invalid, this does not affect the remaining lawful provisions, which remain in full force and effect. Any invalid or unenforceable provision shall, without further action by the Parties, be considered amended or corrected to the extent necessary to make it valid and enforceable.

The Customer has the rights provided by the Law of Ukraine “On Personal Data Protection” of 1 June 2010, No. 2297-VI.

This Privacy Agreement applies to the Customer from the time services are received from the Registrar and remains in effect for as long as any information about the Customer, including personal data, is retained.
